discretionary leave,Claiming benefit as single

Hi i want to ask a question onbehalf of a friend , if a person is on discretionary leave based on article 8 and 3 and is claiming wtc,ctc,hb,ctb,and child benefits as single,and his parner is on tier 1,can it affect the person if he/she wants to renew the discretionary leave, or what can he do to rectify these?finally what form can he use to make an application for an extension of his discretionary leave,ie form HPDL or form SET0
