Refusal- Sponsorship Letter

Hey everyone,

I need any advise or two cents regarding this matter. I applied for a PSW in September, got the go ahead on the Biometric appointment in Oct. Then today (3rd Nov) I received my passport with a letter of refusal.. everything was given the green light (75points in total and no problems with maintenance whatsoever), it was just the sponsorship letter that i attached to my application.

I completed my 3 year undergrad studies in architecture and currently need to do a year out in practice before resuming my part 2 (equivalent to masters) to complete the course. Basically the problem stems form the fact that I am a student who was under full scholarship, and UKBA needed an unconditional letter from my sponsors to show that they do not object to my application for the PSW Visa. Hence in my application I included a letter from my sponsors stating that they do not object to my application for the PSW Visa for my professional experience, but I am expected to resume my masters in 2012. UKBA stated that this makes the letter conditional and therefore does not satisfy their requirements.

I'm not sure if it is because of the fact that it was not mentioned where I am going to be studying in 2012 (i will be continuing in the same uni in the UK), that it makes it vague perhaps it portrays that I might be returning home or anywhere else in the world to do my part 2?

The ironic thing is that someone I know applied with the exact same document and got the visa just a few weeks before I got my refusal letter.
Perhaps it's also depending on the person that assesses the documents..?

I've been advised to appeal but feeling a little distressed with the whole situation. Any advise?

Have you been awarded a full degree now that requires no further treatment and could simply not return next year (for the masters part) and this would not alter that? I don't see how you can say they have awarded points for the degree but then not allow the degree because it's conditional.

Lucapooka - I think you have misunderstood the OP. It's not that the UKBA think that the degree is conditional - the refusal is not related to the degree. The application has been refused because the applicant received official sponsorship for his/her course and therefore the official sponsor needs to give unconditional consent to the applicant apply for leave under PSW following the completion of his/her degree.

I don't think it's the matter of the degree that they are disputing. Basically under normal circumstances students under full sponsorships are required to return home as soon as they are done with their studies.

Mine is a complicated situation one as to be a qualified architect i need to do a year out in practice, then complete my part 2. My sponsors are completely fine with me doing my year out here and since the only visa i can qualify for is the PSW Visa at the moment, they willingly issued a consent letter, but just noting that I would be returning to uni after my year out. I was also told by an advisor that it is possible to return to uni on the second year of your psw visa.

Now I'm with you but that asks for permission to remain or re-enter the UK without condition. Are we saying that the condition of having to return to study is covered by this paragraph?

39. If the applicant is currently sponsored by a Government or an international scholarship agency, or such sponsorship ended within
the past 12 months of this application being made, the applicant must provide us with the sponsor’s unconditional consent in writing to us, giving the applicant permission to remain in or re-enter the United Kingdom. If the sponsor does not give unconditional consent or gives permission for a limited time, we will refuse the application.

I see what you mean, but because my sponsors will still be the one sponsoring me to do my masters in the UK over the next few years, would that not mean that they themselves are giving me consent to remain in or re-enter the UK?

I suppose perhaps their letter does not clarify the situation completely and it could have been read as a deadline to my stay in the UK rather than a clarification that they will continue to sponsor me to stay in the UK after..

Can somebody please put here the template for the sponsor’s unconditional consent in writing. My sponsor need that to prepare for my Visa. Thanks!
