EU spouse visa

Currently i am on non-EU student visa in UK. Recently i got engaged with a german national. She is currently living in germany. Now we both want to settle here in UK after marriage. It is straight forwad for her as she is german national so i want to apply as her spouse in UK so can someone please advise me the procedure to apply for EU spouse visa after marriage ?

Wait for her to come to the UK and start exercising Tretay rights, get married, then apply for Residence card.

She is coming in March to UK with her family and then we will get married. Only problem i have is that my student visa is going to expire in august so whats to know if she really has to exercise Treaty Rights for me to apply for spouse visa as she is german national ? Somebody told me that nationals of some countries don't need to exercise treaty rights for their family member to apply for family visa, is germany one of them ?

Also can you please advise the procedure to exercise treaty rights ?
