spouse visa extension on benefit

Hi

I came across your web site while trying to search for some advice

I am British and my wife is Thai we have a 22 month old daughter of dual nationality and my wife's 2 year spouse visa will expire in October 2012

I am self employed and working but during the time she has been here profits have taken a nose dive and I now qualify for benefit

(housing benefit, council tax benefit, working tax credit, child benefit and child tax credit)

Does this mean that my wife will be refused an extension to her visa ? and if so is there any steps I can take in avoiding the break up of our family?

Don't worry you are entitled to these benefits and the Home Office is more concerned at this time at your continuing relationship rather than your finances.Why not appy for ILR instead of extension?

simonb63 in fact Home Office case workers are instructed not to refuse ILR for a spouse due to lack of finance. Apply on form SET(M) as long as your wife has passed the Life in the UK test or completed an approved ESOL course.
