I am in need of some sound advice on what my partner and I should do in a potentailly difficult situation. I am seperated from my husband (2 years) and currently divorcing. My partner is here (UK) without any papers, and we want everything to be above board as soon as possible.

Can you please suggest a course of action so we can be together and everything be legal!? Thank you

As regards your partner, can you post a bit more detail about his UK immigration situation?

And for you, when do you expect your Decree Absolute to be issued?

My fiance came here when a war was in his country and did not return for fear of what he went back to. So he has stayed and been here since 1999. My decree absolute will be through in approx 2 months. I have read that getting married in the UK is an option, for him to go back and apply for a fiance visa is another.......not sure what to do next?

Can you say which country he is from? And would it be safe for him to return there now to apply for a fiancé visa? Has he ever applied for asylum? If so, the result?

He is from Albania and has never applied for Asylum. We have discussed a Fiance Visa, but this would mean he could not work and this is something he wants to do.

The fiance visa would just be a temporary solution in order for your partner to return to Albania and get a visa that would allow him to legally return to the UK.

Once back in the UK the two of you could immediately get married (assuming your decree absolute is through) and then apply for a spouse visa for him which would allow him to work. Of course once he's had the spouse visa for 2 years he will be able to apply for indefinite leave to remain and then after another year apply for naturalisation.

A much quicker solution would be for BOTH of you to go to Albania, get married there and immediately apply for a spouse visa from the British embassy in Albania. This would allow your partner (husband) to immediately work on his return to the UK.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

If I was to go to his home country and get married, what paperwork would I require and how long is the usual wait for a Spouse Visa?
