Applying for PSW after being refused at the UK Border

Hello
I'm in the process of applying for the PSW in Canada. I meet all the requirements for the visa.

I was recently refused a Tier 1 Exceptional Talent Visa (I did not meet the requirements according to the UKBA) and I was also recently refused entry to the UK and my current student visa cancelled with 30 days left on the student visa. (Hence the PSW application) This was because, according to the UKBA, I was seeking entry clearance for the purpose of employment, not to study. My course finished in July, yet my visa was valid until 31 Jan 2012. I explained this to the official but the decision was already made.

I have a solicitor helping my application this time, I'm including a letter of support from him, and I'm also including a letter of explanation of the situation from me.

Do you think my application will take longer to process because of these 'faults' on my record?

Do you think I would be refused the PSW from the 'faults' on my record?
