hello. I am a new comer here.

This is a great forum. I would like some guidance.

I have been working for a National company, Internet Services Engineering, for about 19 months, while having a PSW visa; which is about to expire in couple of months.

Switching to Tier 2 now; will my work with them, which is a permanent contract, be considered when applying for Tier 2? I dont have the maintenance for 3 months. My pay was coming into my bank account every week which can be cross checked by the invoices generated by the organisation and emailed all along. I have 3 dependents.

Where do I stand? Please someone.. Thanks.[/code]

Hi

Please give a good read to the Tier 2 Guidance.

As PSW worker who has worked for this company for over 6 months, you should be able to make use of the facility of switching from PSW to Tier 2. This negates the need for maintenance. (even for dependants as mch as I know).

Why would your pay need to be matched with invoices generated?
Have you been contracting or getting paid monthly, if latter, you need payslips to prove that you have been working for 6 months with this company.

I am so grateful for your reply, I think the same.

I have been contracting, so I am not on their payroll, but it were regular invoices paid every week without a single miss over the 18 months, and all the engineers were requested to be responsible for their own taxes, and be self employed registered.

I spoke to the HR department this morning, and they weren't sure about Tier 2, I explained and they said we will look into it.

I checked the Sponsor Licence register and do not see their name there. I did tell them that applying for the sponsor licence is simple and any costs incurred I will gladly pay.

Am I heading in the right direction mate?? Cheers

So you are self-employed? To sponsor you your company must first register with home office and then produce a COS for you. Eventhough you worked for the company as "self-employed" contract basis I don't think you will gain 30 points for switching from PSW cause you must have been employed by them and worked for them. Your employer may be required to do a RLMT.

I can't confirm this but to my knowledge this is what I think...

Wait for more advice.

Thanks alot for your reply.

As for the RLMT, I guess to fulfill that the sponsor needs to advertise etc. They had done that nationally through the Job Centre. This was done around 18 months or so earlier and they recruited nationally hundreds of engineers, by recruited I mean working for themselves.

So I guess the RLMT is done.

As for the CoS, yes I think that unique number needs to be obtained visa ukba which is £1,025 for Tier 2.

Also, I have been working for them, only, its like a full days job, 5 or 6 days a week. So its not as and when needed kind of job, been paid every week, worked every week.
