SOC code and Maintenance fund requirement

I’ve got few queries and I’ll be thankful if anyone could help me.

First query is related to the job title - Does the title have to match exactly the same on SOC code list or if few of the descriptions match but job title could be different. e.g. some of the descriptions for code 3539 matches with job description with my potential employer but the title do not match as it is business analyst in the new company. I’ve also looked for another job title for business analyst on the code list and found 2423 that could match couple of descriptions but there is a good gap between salaries. Please could anyone suggest a way out?

Second query is related to Maintenance fund – I am switching from Tier 2 ICT to Tier 2 General, Do I have to satisfy this requirement? I am confused because on the application form it does say that if you are already under Tier 2 then you don’t have to but doesn’t specify which Tier 2 category. Does this means this hold true for every Tier 2 category or only for some specific Tier 2 categories.

Job description is the most important bit.

Only your employer can make a decision on it. Of course, you can influence your employer's decision!

Once you have narrowed down to your preferred job SOC code, and you satisfy condition 100%, and employer is willing... You put that SOC code and job title in your cos.

However, your sponsor should mention on COS in "sponsor's note" that job description matches with your current duties, but job title doesnt. So we/employer will officially use xyz job title instead.

This reply is based on UKBA advice to my employer...

English Language requirement and Maintenance

I provided evidence for English language requirement when I extended my current Tier 2 ICT visa beyond 3 years. Now I am preparing my application for Tier 2 General, do I need to provide evidence for English Language again??

Also, as I am switching from Tier 2 ICT to Tier 2 General, Do I have to satisfy Maintenance(fund) requirement again??

I would be grateful if anyone could share their thoughts/experiences please.

Hi Agastya80,

Please refer to Tier-2 Guidance, Bullet point 114. This will tell you whether you need to show proof of your english language skills or not.

114.) You must score 10 points for your English language skills, unless you are applying under Tier 2 (Intra-Company Transfer) and you are not applying to extend your leave in this category beyond three years total stay in the UK. Any time you have spent as an Intra Company Transfer work permit holder does not count towards the three years.

Hey Tckraju, many thanks for your reply. I’ve read through the guidance and confused because of following text under point 120 -
You can claim 10 points if you: Are applying for leave to remain under Tier 2 and you have or last had leave granted in one of the categories listed below:
- Tier 2 migrant under the Rules in place before 6 April 2011, excluding Intra-Company Transfer Migrants who are applying to take their total stay in the UK beyond 3 years.
- have previously been granted leave under a Tier 2 category, having already provided evidence of meeting the English language requirement (If you are applying under Tier 2 (Minister of Religion) you must have last been granted leave under this category for this to apply); or

My last leave granted was Tier 2 ICT beyond three years. But do I have provide evidence again just because I’m on Tier 2 ICT or not as I’ve already provided them with the evidence last time?

Yeah, thanks for your reply. I think I'll to satisfy this requirement again and so is Maintenance requirement even though I'm under Tier 2 ICT.
