BNO v's British Passport - Marriage....

Post by mat1z » Mon Oct 16, 2006 11:45 am

hi everyone,...

what is the law in respect of someone with a BNO passport (hong-kong) marrying a british passport holder here in the UK?.

her mother holds a full UK british passport.

an islamic 'nikaah ' has already taken place.
does it look like it will be a trip to hong kong to marry her there?, or can it somehow be dealt with here?.

Thanks.

If the BNO isn't "settled" in UK, a Certificate of Approval will be needed - this page on the IND website will enable you to ascertain whether this is possible.
But although a BNO will normally be required to apply in Hong Kong for a fiancé(e) or spouse visa (unless they are legally resident elsewhere), there's no law that says that the marriage itself can only occur in Hong Kong. The marriage can take anywhere, provided the legal requirements of the place are met. So you could marry in (say) Las Vegas if you wanted to - provided you understand that the spouse visa application will need to be submitted in HK.
