Do I need to include my child

Dear ALL,

My child was born in UK and is now four years and most of the time was in uk except for the vacations. Total time spent outside uk is around 6 months in these four years.

I am going to apply fir ILR. At that time do I have to include my child or I can exclude my child and then later apply for the citizenship. My child is on tier 2 dependant visa at the moment

As your child was born in UK, you don’t need to include him in the ILR; you case save money and apply directly for British Naturalization.

You only need to include him in your ILR if you plan to travel in near future as the naturalization + passport process can take up to 3 months in total.

But as I said if you have no plans to travel, then don’t need to include child in your ILR.

One more question is that my elder child is in india and has not been to the uk for past four years. What to do for his ILR. Will there be any problem, specially when his visa now has expired.

Elder child will need to apply for the appropriate entry clearance, depending on your status, before travelling to the UK. If elder child returns prior to parent's ILR application, then elder child should be included in parent's ILR application.

With all respect I would like to say that I know that my child who is born in india now will have to apply for appropriate entry clearance.

But the confusion or scare is that will the visa office refuse my son as he did not come to uk for last 4 years or so even after having a valid visa.

If he is with your wife, then it should be okay for him to return with her. Else, showing sole responsibility is normally expected.

No he is with my parents.
Me my wife and our child who was born in uk is here and now on tier 2 and tier 2 dependant

We are now in the process of making the decision about our son's visa who is india and his visa is now expired.

We want advice on what to do for our son in india.

shouldd we apply for tier 2 dependant for him and call him here and apply for ILR
OR
we apply for ILR and then apply his ILR equivalent in india and then call him here.

We are applying for ILR in march 2012

If you're not sure that you're going to be granted ILR, then it's better to wait. Apply for a child settlement entry clearance after you're granted ILR.

I think there is some confusion

I will be applying soon for ILR and I think I will apply for my son later.

I was asking that woul the visa office refuse for my son as he did not come here for 4 years, if there is some thing against his application due to this then I want to provide some reasons to them and so on.

I am thinking to go through solicitor
