ILR rejection - tier 2 possible?? pls help

I should take your advice atleast now..

I came into the UK in July 2006 (Work Permit), applied for ILR in June 2011. I was convicted for drink and driving offense in Dec 2007 (still have it), but then I was sooooo stupid that with the letter I received from the court (lifting driving ban) in 2009, I was under the impression that my conviction was spent and applied for ILR (PEO) in June 2011. Received a rejection letter in December 2011 stating this offense, with permission to appeal. I appealed and again now, a rejection letter with an application for permission to appeal to upper tribunal..

I've to send the application form by Monday (30th Jan 2012).. I know this will not get thru' (this is just to borrow some time), but then, I contacted a solicitor to find out if I have options.

My employer does not have a sponsorship license, she is willing to apply for one, it's a small company, I don't know how long this will take.. After I get this I want to apply for Tier-2. My WP expired on June 21st 2011. Will this offense, WP expiry and ILR application rejection affect my Tier-2?. If not, how long will it take?? Can all these happen before the deportation notice is sent to me?? I have checked and yes I meet PBS criteria..
