Unmarried partner with UK partner living outside the UK

Hi,

I am under the Unmarried partner visa. My visa was granted in October 2010 and I suppose to apply for Indefinite leave to remain later this year. My partner was offered a job in the Middle East last March and he is currently living and working over outside the UK. I am still in the UK, he does not want me to lose my UK visa.
We are getting married before my visa expires but we are worried that they will denied my visa because my partner is not living here.

Does anyone know anything about a case like this? I have been looking in the UKBA website but I cannot find anything to help us.

We have proof that we are a genuine couple. We speak every day and try to see each other as much as possible (5 times in the last 10 months).

If you and your partner have not been living together in the UK over the two years, you cannot show your relationship is submitting, and you do not intend to live permanently together, your application is likely to be refused. You need to seek advice urgently on your situation.

no - it doesn't change the fact that your partner is living and working outside the UK.

I found this on page 19 of the FLRform: "If you did not live together for any part of the 2-year period, tell us the reasons for this and whether you stayed in contact with each other during this time, and provide any relevant supporting evidence."

I'm not sure if this applies also for the ILR.

We are not married yet! We have organize the wedding in July. And yes, he is planning to come back. The whole point fot him to go over there is the current situation in the UK. We do want to leave here but we didn't want to end up asking for benefits. He left to try to be able to save some money and pay some debts.

Would it help if we get married asap? We have the license and everything ready for summer, but if it help we would do it now.

As Greenie's previous post "no - it doesn't change the fact that your partner is living and working outside the UK."
Marriage won't make any difference to the situation if your husband isn't living with you.
