Tier 1 General Extension- Qualification Points

Dear All,

I have a leave till 24th April 2012. and have to apply for Tier 1 Extension. In my first application I apply on behalf of my Bachelor's Degree. My question is can i carried forward the same points for this what I achieved in previous application or i will not be awarded any point for this.

Because as per UKBA Tier 1 Guidance, in para 56 they state:

" An applicant will be awarded no points
for a Bachelor’s degree if:
(a) his last grant of entry clearance was
as a Tier 1 (General) Migrant under the
rules in place between 31 March 2009
and 5 April 2010, or
(b) (i) he has had leave to remain as a
Tier 1 (General) Migrant under the rules
in place between 31 March 2009 and 5
April 2010, and
(ii) his previous entry clearance, leave
to enter or leave to remain before
that leave was not as a Highly Skilled
Migrant, as a Writer, Composer or Artist,
as a Self-employed Lawyer, or as a Tier
1 (General) Migrant."

Please let me know I am stress now and need confirmation whether can i get the same points or rewarded no points for that.

When did you get your first leave granted?
I assume you are worried as NO points were awarded for applications filed between 31 March 2009 and 5 April 2010.
You will be awarded SAME points as they were awarded for the Initial Application.. but yeah , If you have secured a higher degree during this time then you should be getting more points.. but minimum points awarded for your qualification should be atleast same as that of the first application.. In your case I think atleast 30 for the Bachelor's degree.. So chill, dont worry

for your prompt reply, I have applied before 31st March but get visa on 24th April 2009. Get points for my Bachelor's degree as well. But don't know whether they will award the same on extension as well.

you will be awaded points for Bachelor's Degree that is 30 points.. Your initial application was made before the rules changed..

Hi Ali and dilip_gem, I found this post via google as I'm facing the same situation.

Currently holding Tier 1 General and applying for an extension before it expires on 19 May 2012. I only have a Bachelor degree. I believe my original Tier 1 was applied before 31st March 2009 but the date on my visa is 19th May 2009. I'm very concerned that whether I could claim that 30 points for education. If not I will be five points short.

I don't think I can produce any document to prove that I submitted my application before 31st March 2009 other than the date "19th May 2009" on my visa.

Hi frhong,
You were granted visa based on the rules that were in place before 31-Mar-2009 and so you should be getting 30 points for education for the extension appln. Visa start date doesn't matter, I know a person who asked and got visa start date almost after six months from the application approval date. And as far as I remember after 31-Mar-2009 for a brief period they were granting Tier-1 for ppl having Post Grad degree.. But in your case since the application was made before the change in rules took place. You should be fine. Don't need to worry. If you dont remember the exact application date you could mention in application form/covering letter that your application date was before 31-Mar-2009, however you do not remember the exact date. Hope this helps.

Thanks for the reply, it's really helpful and does ease my stress out a bit. My concern is where can I prove my granted visa was based on the rules that were in place before 31-Mar-2009. I'm worrying that they can just reject my extension application by stating I'm not as the date on the visa is May 2009.

It's really helpful to have an active member like you on this forum. May I ask are you from a legal immigration advisory background?

I was in stress as you are, but as Dilip_Gem was saying no need to worry about.

I think you can show your covering letter as a proof of you application date, I have that one in my documents over and above i manage to find my credit card statement showing that transaction has been deducted before 31st March 2009.

if you have paid your fees credit card i think that it will be suffice to prove that you have applied well before 31st March.

Just in any case as per the link on UKBA website above they have the record for date of application and thats why you have secured 30 marks for your Bachelor in first instance. Otherwise they wont give you any points.

Thanks Ali, your message is really helpful and I have also managed to find the record from my bank statement that Home Office took my payment on 25 Mar 2009, which I'm sure can be taken as approval.

When you said "covering letter", is it the one issued by the Home Office?

Hi guys pls i want to know what is my chance ? i apply for hsmp letter in may 2008 and my hsmp letter was approved in sept 2008 i apply for my visa from Nigeria in November 2008 but i was refused the visa in December 2008 i got the notice of visa refusal in january 2009 the reason given by ECO is that that i forged my identity and i appeal the refusal in february 2009 in november 2009 i won the appeal and i was called from embassy to come for the visa and eventually i got the visa in january 2010 i was given 3 years visa instead of 2 years my question now is i used bachelor degree to apply for my hsmp letterr in 2008 but now i read it in ukba website that if anybody that was grant visa after march 2009 can not claim point on bachelor degree and is this bachelor degree that i used to apply for my hsmp letter that lead to my initial visa application in 2008 and i will soon due for extension jan 2013 pls advice me.
