Help!!! Got a job offer but still need to wait for my visa!!

Help!!! Got a job offer but still need to wait for my visa!!

Hello!

I gave my Bio on 10th Jan., and I know that there will still be a long way to go until to get the result. But I have just got a job offer and they probably gonna start the training at begining of Feb... But I'm afraid I cannot get the visa at that time... I really don't know what to do now because without my passport and visa, they might just not let me keep going with them...

What can I do?? Is it possible for me to contact Home Office about it???

Can someone tell me how can I solve this issue??? Or I just give the job up????

you really need to tell us your background over here!

what job offer? u have a NEW job offer while your tier 2 application is still outstanding? do u want to stop working for current employer? did u think about the notice period that you must give to your employer???

I assume since the OP is posting in the PSW section that s/he has applied for PSW not Tier 2.

are you switching from tier 4 to PSW?

Is the job offer permanent?

Hi, thank you for understanding. I actually just graduated from uni, so i havent been working yet. My visa now is still student visa, and i've applied for PSW visa, still waiting for answer.

Hi thanks for reply! Yeah i'm switching my student visa to PSW... the job offer is permanent! So I really don't know how to deal with it... my employer just said that he needs my passport and need me to be eligible to work in the UK. I told him I'm waiting..

you can't work in a permanent full time position whilst you are waiting for a decision on your PSW app as you are still subject to the conditions of your tier 4 leave.

You have the right to work as long as you had the right to work under your tier 4 leave and made an in time valid PSW application. Your employer can call the employer's helpline to confirm you have the right to work, however given that the position is permanent you cannot start this job until you have been granted leave under PSW.

An option would be to get your employer to offer you the job on a temporary i.e. contract basis, until you obtain the PSW visa. As has been said, you cannot take up permanent full time position until you obtain the PSW visa.

Sorry that I have another question about part-time work. If I can work part-time until I get my PSW visa, but before I get it, my student visa expires, how can I deal with this issue?? My student visa expires on 31th Jan., but I don't think i will get my visa at that time, still need to wait. Can I still work part-time even it expires?

I didn't say that you can't work full time, I said you can't work in a permanent full time position. if you have permission to work as a student you are permitted to work full time following completion of the course, so this will remain the case whilst your PSW application is outstanding, you just can't work in a permanent position.

You can continue working under the conditions of your student visa regardless of it expiring, until the UKBA send in their decision.

Do note that you can work full time, as stated in the conditions for your student visa. The point is you can't take a PERMANENT role. You can however take a TEMPORARY (typically called contract) role.

Basically your employer, instead of giving you the job on a permanent basis, can instead give you the same job but on a fixed term contract. For example, 6 months. If you then get the PSW visa, the company can change your role to a permanent position. Just an example for you to consider.

I'm actually in the same boat here. I have a job offer which I expected to start in Jan but my passport and documents are still at the Home Office. It's a permanent offer and I'm switching from Tier 4 Student to PSW.

I did expect to have my docs back in time but to no avail; and I've had to bitterly inform the employer of this fact. They have agreed to hold the position for me but I'm sure they won't hold it too long...which would be heart-breaking after all the hard work put into landing an offer. And even if they were to switch me to contract, I don't have my passport to prove my eligibility to work even on that basis because UKBA has it.

I really don't expect a solution here but please feel free to throw in your 2 cents.

That's a shame, it must be giving you unnecessary stress. Hopefully your passport comes through quickly. Like you said so much work goes into getting an offer...

It isn't always easy for an organisation to fill a position, so I hope for your sake getting someone else to take that position wouldn't be an easy thing for them.

I really don't know anyway you can show your employer proof of your visa status without your passport though.

If they like to swich you into contract, there is a way that UKBA allow your employer to check your work eligibility in the UK. I can send the document to your E-mail if you want. Just send me your E-mail in a private message. I got the job offer as well, but same as you, still waiting for visa and passport.. and if I'm lucky enough, they will hold my position until next week, I'm sure I will get visa next week. But it's really painful to wait.. i understand.
