timescale for a discretionary leave

Hi,
Does anyone knows whats the timescale for discretionary leave? My solicitor lodge my documents last October 28,2011 FLR (O) under Human Rights and until now we havnt heard anything from them yet. Though the Home office already debited the home office fee november 1, 2011.

I am just wondering as well if am i allowed to work while waiting for the result?

If you are currently an overstayer/have no leave, then you should not work until new leave has been granted.

Thanks, yes i am not working since my visa has been refused. But do you have any idea whats the time scale?
