Senior Care Worker- Code of practice. Advice needed please.

Post by babysofea » Wed Jan 18, 2012 6:23 pm

Hi all.
I work as a Senior Care & Development Worker with the same company.
I started with a WP in March 2007 and granted for 30 months. Extend under transitional arrangement and was granted flr Tier 2 but was 3 months short from 5 years. So again applied for extension and granted FLR until 2013, on biometric card says PBS.

My question is:
1. Would I qualify for Ilr with such mix visa?
2. Can I apply at PEO? (is it straight forward)
3. Will I be exempted from the paid at or above the appropriate rate for the job as stated in the codes of practice as this job is no longer on code of practice?

I have NVQ3 and get paid £19500 - 40 hours (works out around £9.37 an hour)

Has anyone under the same job category applied for Ilr recently?
Any advice would be appreciated.
Thank you.

Mixed categories are not an issue (as they are all valid categories).

As long as you are getting at or above the threshold for your job, you should be fine for same day application and your case would be considered as straight forward (assuming there is no other issue in your case).

Can someone confirm please

Post by babysofea » Sat Jan 28, 2012 7:16 pm

Can anyone confirm if the code
6115 Care assistants and home carer
have been removed from Tier 2 Code of practice please?

If so, does this mean those who has been granted them will not be able to apply for settlement?

Can someone advice, if there is a nearer code of practice to this?

Please help @moderators

Thank you.

code of practice- Urgent.

Can someone please comment.

I have been issued a letter from the company today, and they are still using 6115 Care Assistant as the code of practice as I could not suggest any different.
I am really worried about this ... The lady at HR said to me that she is off on annual leave starting from Monday, 13th Feb for 2 weeks so any amendment/correction, she needs to know by tomorrow otherwise it cannot be done in time.
I am pleading for someone who have any knowledge about this to comment, please.
The company has very little knowledge of the rules as I am the only sponsored worker.

Please help.
