Work Permit Transfer - Working for the old employer

Hello,

I am in UK on work permit. I have received a new job offer and my new employer has already applied for the new work permit.


1. Should I resign from my current employer before receiving the transfer or is it best to wait till I have the approval?

2. Is the change of employment application have a start date which tells me the date I can start working for the new employer or is it effective from the day the transfer is done?

3. I have to give a month's notice period to my current employer. So, once the transfer is issued is my old work permit still valid so that I can serve the notice period for my company?

1) Better wait for the approval

2) AFAIK the u can start working for you new employer from the day you get your WP approval, provided your current stay in the UK is legal.

I would wait until you have received the approval for the new work permit before resigning from your current job for the simple reason that you are never 100% guaranteed of having your new work permit approved.

Can you imagine the sticky mess you could find yourself in if you resign your current job first and your new work permit application is rejected?

Yes I also was thinking that if it gets rejected Ill be in a worthless position. So, I better wait for the new work permit.

My current visa is valid till March 2007. My new employer advised me to get the FLRIED for the new work permit within 6 months of issue. But, I read somewhere in this forum that you need to have the FLRIED first before joining. So, am a bit confused. Could you please clarify on this?

Also, I have had a baby recently and I need to register him and also apply for his passport. For this it requires my original passport. Could you also suggest that should I apply for my son's passport first or should I apply for FLRIED first and then again apply later for the dependant visa for my son.

Any suggestions on this?

Your new employer is correct. You have 6 months or until your current LTR expires (whichever is sooner) to obtain FLR on the basis your new work permit approval. But you may start working for your new employer as soon as you receive approval from Work Permits UK.
