ILR..,Spouse visa..., and going back to school...Please help

Post by Prince1 » Tue Oct 24, 2006 11:16 am

I will be applying for ILR when my wife will only have stayed on a spouse dependent visa for 1.5yrs..... will she qualify for ILR at this time, even if she hasn't spend 2 years in the UK.

Will she also be considered as home student if she wants to study..(i.e if she has ILR but have not stayed in the UK for 3 years).

Thanks in anticipation of your help

What is your current visa. You say spouse dependent visa can you explain it a bit more. For example if you are on a Work permit or HSMP and your wife is your dependent, she can gain ILR as your dependent as soon as you get ILR your self. If however you are settled (citizen or already have ILR) and your wife has a two year spouse visa, she needs to wait for two years to complete.

Regarding your second query, check with the University directly. Most universities required ILR AND three years residence. Best thing is to check directly with the University she intends to apply.

Hope it help

Absolutely not! There is no chance of her being classed as a Home student ... well not for some time.

Many websites of Universities cover the rules in detail. For example, this webpage from the University of Bristol does a good job setting out the rules.

Ok, the good news is that your wife will get ILR at the same time as you get it your self. No matter how many days she has spend in UK. Just don't forget to add your wife as your dependent in the ILR application.
