British Citizenship/ Driving without insurance

Post by need to Know » Sun Feb 12, 2012 4:20 pm

Hi All

I wonder if anyone can help me with this. I meet all requirments for Naturlisation however I have a driving conviction of driving without insurance.
This is through no fault of my own. I was employed and the company I was working for gave me a car to use for work related duties during the day. I was pulled over by the police and was informed I was not insured to drive this car. I recieved a fine which the company paid and 6 points on my licence. I did never think it would impact on this at the time.

When I found out a few weeks ago I contacted my former employers and they gave me a letter stating that I was not aware of the car not been insured and that they were responsible. Not sure if this will make any differnce and am nervous nto take a risk and loose the monies i need to to pay.

Please advise asap

Well HO can say that if it wasn't ur fault (even if you attach a covering letter) then why you had to get 6 points on ur licence? If it was ur company's mistake then they should have faced those points not you!

I know you were driving but it was company's car not urs so technically ur comapny was responsible for the insurance as well as for the points so u should have apealled against the points.

So my thinking is you have a 50-50 chance but let see what others say on this...

Note: Driving without insurance does come under major offence :(

I hear what you say but I had no idea that it would have this impact and secondly my wife was expecting our first baby at the time so I was more focused on trying to find other empoyment which was stable and without such incidents which I have found and i have been there for the last 2 years.

Driving without insurance is a strict liability offence. It is no defence to say that you were not aware that you did not have insurance.

Well I think you really can't prove urself innocent through a letter because to be honest it can't prove ur situation...

Strict liability means that it doesn't matter if you were aware of it or not, if you were driving without insurance, you are guilty of the offence.

I think it probably best to leave the application till the conviction has been spent.

Thanks

I'm afraid there is no way in my knowledge through which u can revoke ur points...
even if u contact DVLA they will ask u why u didn't told us at the time of receiving points or why you didn't went into appeal.

So its too late now for any action
