Hello there,

I have been struggling with this issue for a while, and the helpline is a little confusing as we don't seem to fit into any category... I hope someone can help!

Husband - Russian, Wife (me) British
Married in UK 9 months ago, following which moved to Italy where we both worked and lived until November. Applied for EEA Family Permit in Rome as was only option for us then, despite my British citizenship.

Now in U.K, husband has got a job and is working full time. I have a part time job, which should lead to full time but right now isn't bringing in a huge amount of money. Living in family home for free and have savings.

So my worries are...
1) The form is tricky to fill in as it assumes that I am not British, so asks for Health Insurance etc.
2) I'm worried my job isn't substantial enough to apply, but the job situation is horrifying right now! I have got into a school though and it should lead to more hours, but just now could be as little as 3 hours a day, about 3 weeks out of 4.

Is there a basic guideline to how much you have to work? Or a minimum income? Will my husband's income be taken into account?

Thanks in advance for any light you can shed.

health insurance is not relevant in eea2 application and yes you can apply under eea2 under eu law for your russian husband,all u need is your marriage certificate and proof you exercise you treaty right in another member state ie italy and that you are exercise your treaty right here in uk.you can do this with your payslip and letter from employer that you working

CSI (health insurance) can be relevant also for EEA2 (if the EEA national is a student or self sufficient). However, aquafreddo is in employment, so for her it is not an issue.

There are no strict minimum thresholds for the amount of work or the money that you earn, as long as you don't need financial support from the government (public funds). The employment status of your husband is totally irrelevant for this application.

As sikaba pointed out, you need to provide evidence that you exercised treaty rights in Italy, and hence have the right to be treated as an EU citizen rather than as a British citizen. From your description of your situation I don't see anything that you need to worry about in particular. Because your husband did get an EEA Family Permit to travel from Italy to UK, it means that UKBA has already verified most of the conditions needed to issue a Residence Card.
