Help Appreciated

Post by mrmike » Thu Oct 26, 2006 12:17 pm

Hi Guys

I'd just like to thank everyone in advance for advice/help, I've been reading through this forum for a while and it seems an excellent

resource for people who are often in very stressful and worrying situations. First of all I'll give you a breakdown of my situation, I am a

New Zealander who has been living here in the UK for 3 years, 2 of those years on a WHV and the last year overstaying this WHV. My Intention

is to return home to New Zealand in December and getting married to my partner (she is English) and then obviously after this apply for the

spousal visa. Therefore I have the following questions which I would really appreciate any help with

1) I am still in full time employment in the UK, would it be wise to use this information in the application or could this land my employer in

strife?

2) Obviously I have been a overstayer for a year now and after reading previous and similar posts people seem to think it is best to be honest

about this as due to the visa being for settlement this will not be taken into consideration. Therefore how is it best for me to approach

this topic?, it seems a bit tricky.

3) Should I enlist the help of a professional immigration lawyer or should I fill out all forms myself?

* Basically I would love to know the best way to approach my situation, what information to use and what information not to use, whether it

is best to be honest on all accounts or whether it would be beneficial to hold some information back, as everyone can imagine I am finding the

whole process a bit daunting and very stressful so I'd love to hear from people who have been in a similar situation as myself and what they

found the best approach and also from any moderators who are experts in this area.

Hopefully I will be able to use my experiences to help others in the future.

Kind Regards

Mike

also one other question, what are the actual rules in regards to financial situation, surely if I myself have considerable savings this would mean my partner/'sponsor' would not have to be as financially secure?

thanks

Ok thanks for the reply

May I ask why it took so long (4 months) as the current waiting period states 6-8 weeks, was it because of your situation
