My fiancee has had her passport at the home office for over 3yrs now. She had applied to extend her student visa status but had overstayed before she applied. She is to complete her Nursing Next year but her passsport is still at the home office.

We would like to get married. We have known each other for 9.5 yrs now and have lived together for over 7yrs. ( have evidence to show ). We also have a Son of 5yrs.

Do we have to wait for the return of the passport from the HO before applying for the CoA? IS it worth trying for the COA now.

I have been living in the UK for over 13yrs and have indefinte leave to remain

I only know that you need to submit your passport with CoA. Have you queried why it has not been returned? Is your partner's immigration status in limbo at the moment or was her student visa extended?
How long now has she actually been in the UK?
