Do it myself or hire solicitors for EEA2?

Post by sophievanw » Mon Feb 20, 2012 1:29 pm

Apologies if this has been discussed before.
What are the benefits to hiring a solicitor to process an EEA2 application? I'm an EU national and the EEA2 is for my son (5 years old), who now has a family permit. We live in the UK.
Would having a solicitor speed the process up a bit? We really cannot have his passport out for six months, as my husband/his father is still living in France and my son needs to be able to go see his father (who of course does come here too but also has a job etc).
If a solicitor wouldn't speed things up at all, does anyone have any experience with trying to persuade UKBA to speed things up because of family circumstances such as the above? Or do I just have to accept that UKBA does whatever it wants to?

Many thanks for any advice.

Sophie

PS The answer to the obvious question, why doesn't my son have a right to EU nationality, is that we think he does, but he was adopted and the country of which I am a national has to recognize the adoption, which involves lawyers and court cases etc. It's ongoing but could take longer than six months (has already been ongoing for nearly a year).

Hi Sophie

Your case seems straight forward. I am not aware of any adoptions etc but of your son already has a FP and if he is ( obviosuly) dependent on you then just apply for EEA2 with all the relvant documents.

There is no need to pay ££££ to solicitor as the time will be the same if you apply thrugh him or yourself ( up to six months).

Just fill the application form and send it.. when your child and you need to travel out of the UK just write then am email requesting your documents back with a reason. Process of your application will still go on and once you guys are back re submitt your application.

if you are lucky you can get eea2 back in 2-3 months.. i got back in 3 when i applied some years ago.

best wishes
