URGENT ---Please help me on Fiancee/Spouse visa....

URGENT ---Please help me on Fiancee/Spouse visa....

Hello,

I have married to a British national on 2010 in India as per Islamic law while his divorce was under processing at UK country court. I have not yet registered my wedding with Indian government as I have been waiting for his divorce to get complete. Now, He has got his legal document and I am planning to make it official. Here are the question now...

Based on your above link,

1. Do you suggest me to register my wedding with Indian government first based on the Islamic proof (s) that we have currently (though his divorce was under process during that time when our wedding happened on 2010) and then apply for a spouse visa? Do you think will that cause any problem if apply for a spouse visa?
Or

2. Would you suggest me to apply for a fiancee visa and register the marriage once I reach to UK?

May I kindly request you to respond me asap and it is going to really help me a lot.

The UK will not recognise your new marriage if your partner was still in an existing marriage and not divorced at the time this new union was contracted. There is no retroactive procedure to amend this problem and you will have to remarry in a civil marriage in the UK or elsewhere. So, option 2 only.

Application Status

Hello Everyone,

Finally, We have applied ""FIANCE(E) OR PROPOSED CIVIL PARTNER OF A BRITISH CITIZEN OR SETTLED PERSON (VAF1F)" visa and the current status shows "Your Application is being sent to the application center. Please wait until it is ready for collection".

Is our visa got approved? Could you please anyone let us know what would be the current status ? Bit worried !!! (However we do understand that we need to get it from visa application center")

There is no indication in that message of success or refusal. That's normal and you will have to wait until you get the application from the VAC.

Furthermore, VAF1F is a marriage visit visa. It will allow you to visit the UK to marry but you can't settle there.

Yes, I agree that its a marriage visit visa however we heard that we can apply for other visa once at the end of the 6 months to stay for another two years, Is that true? Please help me.

the marriage visit visa only allows you to visit the UK in order to marry, before the end of the 6 months the migrant has to return home and if he or she wishes to apply for a spouse visa will need to do some from his or her home country.

The fiance visa allows the migrant to come to the UK for 6 months, marry in that period and then switch (make an in country application) to leave as a spouse of a settled person, which is granted for two years.

Looks like you applied for the wrong visa.
