ILR, Please Help..

HI All,

Smashing site. Can you please help?

HISTORY: My husband got a ILR (based on 10 year rule) on 22 August 2006. I have been in the UK since September 2004 on dependents visa with two years left on the existing visa (My husband was on work permit). We also had a baby on 5th september 2006 and he now has a british passport.

My husband is adamant that I need to get a spouse visa as soon as possible as my old visa is invalid. Also I need to get ILR as soon as possible.

Can any of you guys/gals please help as I need to travel in 2 weeks time and want to be sure that I am legal.

Kavita, your husband is right, you need to use form FLR(M) to get yourself a 2-year spouse visa. Near the end of that 2-year visa you will use form SET(M) to apply for your ILR.

You will thus appreciate that you delaying applying for your spouse visa is having a knock-on effect of delaying you getting your ILR.

Travel in 2 weeks time? You clearly need to apply in person at a PEO ... the application will cost you £500. And do realise that an appointment is needed at the PEO ... you cannot just turn up without an appointment. Best you phone the nearest PEO in the morning.

Is it possible for me to apply from outside the UK as I am going on holiday to India for 6 weeks. Could i apply for spouse Visa there. How long would it take?

No, you really do need to apply for your 2-year spouse visa in the UK, if only because that is a very much easier process.

Applications at a PEO are dealt with on a while-you-wait basis ... same-day service ... and dependent upon which PEO we are talking about it could take just a couple of hours. But I emphasise you do need an appointment, and you do need to go along with all the required supporting documents.

Which PEO is most convenient for you? Croydon, Birmingham, Liverpool or Glasgow?

OK you could apply abroad, but that is a longer process and surely a lot more hassle.

It may be worth mentioning that the UKinIndia website advises applicants for settlement visas to allow three months for the process...
