Query about EC - VERY URGENT

Query about EC - VERY URGENT

Hi everybody,

Could you please suggest the best for my situation.

I am on work permit visa working in UK for the past one and half years and my family(wife and kid) is also with me on dependent visa. My wife has got HSMP last month and we are planning to get HSMP visa as my wife as main applicant and myself and kid as HSMP dependent so that I will get a flexibility to change my employer.(my current employer is planning to send me back by February-2007) As my wife is on dependent visa right now she can’t apply FLR to change her visa status in-country so she has to apply EC. We are trying for the below options,

Option 1:
All of us return back to India and apply EC as my wife as main applicant and myself and kid as dependent.
Difficulties in this:
Actually my wife is not working right now and she does not have enough bank transactions for the past six months.(But we can show some huge bank balance during EC). So I am not sure we will succeed in EC with this and not sure about other difficulties.

Option 2:
Send my wife and kid to India to get EC by stating husband is living in UK so that she can give all the reference as mine and apply EC. Once she comes back to UK then I can covert my visa to HSMP dependent by FLR.
Difficulties in this:
While I am applying FLR I will have to show the main applicant financial strength but still she wouldn’t have got any job and I can’t show her bank transaction also.

I am kind of very confused please advice me.

I suspect that no one replied yesterday in only because of the need to read the new HSMP rules. But your wife already has her HSMP approval, so at least knows she is in the HSMP for a couple of years. However it would be useful for you to read the new rules, and determine whether your wife will have any problem getting an HSMP extension in a couple of years.

I make that point because it is at least theoretically possible that you might want to stay on the current WP route? I am not saying that should be your conclusion, but merely ask you to think about it.

Assuming you want to continue with your wife's HSMP, it is not necessary for her personally to show lots of money in the bank. It is also possible to show that your money in the bank is there .... to prove that it will not be necessary for any of the family to claim Public Funds.

Accordingly I think either your option 1 or option 2 are viable. Probably option 2 is better, because it keeps you working and earning while the rest of the family is in India.

Actually one other difficulty with option 2(FLR) is I will have to mention the main applicant employment details. I am not sure by that time she would have got a job.
John do you think this will not make any harm to my FLR.
