Australian girlfriend moving to UK

Post by crazyhorse » Tue Nov 14, 2006 9:23 am

Hi, I'm English and living in England, my girlfriend is Australian, we've only known each other for around 9 months but have decided that we want to be together in England. She's not working at the moment but has money and I have a home and a good job. How easy would it be for her to be able to move here? I know she can come for 6 months but what about after that?
Any help would be appreciated.

One possibility is for her to apply for a Working Holidaymaker visa. That is of two years duration, and the person is allowed to work for up to one year during that two year period.

Then if the relationship works out, before the end of the WHV she could apply for a Certificate of Approval to Marry ("CoA"), and then marry in the UK, then apply in the UK for a spouse visa.

If she comes here as a "mere" visitor then it is not possible to successfully apply for a CoA, and as you say, time in the UK would be limited to 6 months. Going the WHV route gives more time in the UK, and ability to work for some of the time.

But how old is your girlfriend? And indeed, has she had a UK WHV in the past?

Cheers. She's not had one in the past as far as I'm aware.

She's 30, does this make a difference?

Is the WHV then getting married the only option?

Can you get anything like a fiance visa or something where she could come over for longer if you plan to get married?

Yes, have a read of INF15 and you will see that 30 is the maximum age!

Fiancée visa? Only appropriate if the plan is to marry in the UK during the 6-month duration of that fiancée visa.

Other possibilities? Might she qualify for an Ancestry visa? Does she have any UK-born grandparents? HSMP? She has a degree? WP? What sort of work does she do?

OK cheers. She'll be 31 in 6 months time, would she be able to apply for one of these whv's before then?

She does have a degree, she does social work. Not sure about the grandparents.

Also worth finding out about non-British, non-Australian parents (and in some cases grandparents): could she be entitled to an Irish passport or the passport of another EU/EEA country, which would enable her to work in the UK? I presume that neither of her parents was born in the UK?
