Gaps in employment when applying for RP (EEA3)

Does anyone know how long a gap in employment can be when applying form RP? Will less then a month mean I did not exercise the treaty rights.

It may depend on the specific case. You'd need to elaborate. It seems like a pretty trivial period of time.
