Dear Reader,
Imagine you are studying on a degree course at the university. In your final year, you come to know that from next year, the entry requirements for the course are changing i.e. instead of 2 A levels you will now require 3 A levels to come on to the course, and also the course content is going to change with a new examination being introduced.
You will think, "Well these changes got nothing to do with me, as I am already on the course". You will rightfully believe that you are going to take the final examination based on the existing course content, which you have studied so far and obtain your award. Simple common sense: NEW RULES ARE FOR NEW APPLICANTS.
But HOW WOULD YOU FEEL if you are told that to continue on the course and to obtain your degree award; not only you should meet the new entry requirements i.e. you should have 3 A levels, but also you will have to take the examination based on the new course content, which you never studied.
You are bound to say, "How can this be…? This is unfair and unjust"
This is exactly what is going to happen once the proposed changes for extension of leave under the HIGHLY SKILLED MIGRANT PROGRAMME (HSMP) are implemented by the Home office on 5 December 2006. The people whose own and families' life would be affected and displaced as a result of these changes; are not the ones who came in to this country as asylum seekers or refugees, with rights to claim benefits.
These are people who have been allowed entry in to the country under a Home Office scheme i.e. HSMP, after careful assessment of their qualifications and experience, first by the Home Office and later on by the British High Commissions/ Embassies. They have come from countries like Australia, Canada, India, New Zealand, USA and many others, to fill a skill shortage gap as identified by the Home Office, which they have done successfully in most cases and also without claiming benefits or using public funds.
The Home office should have honoured its commitment to these people by granting extensions of their visas under the existing criteria i.e. to be active economically legally. But instead Home Office has decided to change the rules of the game mid-way, by proposing to introduce new rules for extension of visa, without sparing any thought or consideration to what effect this will have on the careers and life of these individuals and their family. These new rules are meant for new HSMP applicants but they are also being implemented retro-respectively for existing holders of HSMP visa. THIS VIOLATES NOT ONLY PRINCIPLES OF LAW AND JUSTICE BUT HUMAN RIGHTS ALSO.
