What visa for business visitor if employed by UK company?

Post by manci » Wed Apr 25, 2012 12:22 pm

UK company employs a US national consultant overseas . His consultancy duties are performed entirely overseas, outside the EEA. The person needs to come to the UK from time to time for reporting/discussions, etc.

According to Immigration Rules, Part 2, 45G(h) it seems that since he is employed by a UK company he is not eligible to apply for a business visitor visa.

What type of entry clearance would he need to come to the UK on short visits?

To answer my own question:

since the definition of a business visitor is:

a person who is employed abroad but who intends to visit the UK for short periods in order to undertake certain business related activities

AND

one of the permitted activities for business visitors is to attend meetings

I think this overrides the requirements set out for "consultants" even though he is employed as a consultant. He is therefore eligible to apply for a business visitor visa.
