when to apply indefinite leave for wife ( help pls ! ! )

HI,

someone pls help
I am swedish national but my wife is not

After applying for residence permit we both receceived 5yrs which will be expiring in december 2008.

Now am wondering when I can apply for the permanent residence for my wife. someone said to me that I can apply for it a year before the expiry of the residence which in this case will be december 2007 and i dont know how true that is so can someone pls confirm.

Prior to your wife getting her 5-year residence Card, what did she have prior to that? For example, did she first have an EEA Family Permit to enable her to come to the UK? If not, what did she have?

How long have you (the Swedish citizen) lived in the UK? And what nationality is your wife?

In that case, if you're a Swedish citizen, you automatically became a Permanent Resident on 30 April 2006 (under the new EEA rules). You could have become permanent sooner if you had applied for it.

Use form EEA3 to apply for evidence of your permanent residence.

One year after this date (ie, in May 2007), you can apply for Naturalisation as a British citizen. Sweden allows dual citizenship.

Your wife will get her Permanent Residence after 5 years in the UK. From what you say, around January 2009. If you are a British citizen by then she will immediately be eligible for naturalisation, otherwise she will need to wait a year.

Have you any children, or planning to have children in future?

And EEA4 will be the form to use to obtain her Permanent Residence once she has completed the 5 years.
