Spanish Visa

Post by Netprincess76 » Sun Dec 10, 2006 9:02 am

Hi,

I would like to know if it's possible to change my tourist visa to another type of visa (ex. working visa/permit) once in Spain. Do I need to hire a lawyer/migration agent to be able to change my status legally once I'm there? I am from the Philippines. Any info or suggestion would muchly be appreciated. Thank you very much.

It's not possible unfortunately. You have to apply for a Spanish work permit from outside Spain. In addition you can only apply for a Spanish work permit if you have authorisation to work in Spain. The company that wants to employ you has to get this permission.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Thanks for your response. I've tried to contact several lawyers online with regards to changing a tourist visa to another type of visa and so far have gotten a few different responses from each lawyer. One suggested that I set up a business, another mentioned of a student visa, and two of them said it's possible to change my tourist visa in Spain but there were some specs to be talked about. Now I don't have a job offer in Spain. So I am now wondering if the Spanish Embassy here in the Philippines would give me a work permit/visa without having a job offer. I really don't know how I can go about in doing this so I'm trying to figure out ways on how I can go to Spain and be able to fix my status once I'm there. More suggestions???

I can absolutely definitely assure you that:

a) It is impossible to change from a Schengen tourist visa to any other type of visa from within Spain. This includes a student visa. In all cases you will have to return to your country of origin.

b) You have absolutely zero chance of being issued a work permit from the Spanish embassy in the Phillipines without a firm job offer from a company in Spain willing to go through the pain and hassle of sponsoring a work permit application for you. In addition they will have to prove that they cannot find anyone else in Spain and the EU who can do the same job as you. So you can gather from this that a work permit application is only likely to succeed if you are highly skilled and have a firm job offer.
