Hi,

I have tried to read the post and tried to find the answer to my questions but could not find it, so please help me with my query.

I am PBS migrant and qualify for the settlement. My visa expires on 27th Sep 2012. My wife (dependent) visa expires at the same time as mine.

She does not qualify for the Settlement as it has not been 2 years in UK.

My question is when can she apply for the Further Leave to remain? My passport will be going through the settlement process.

As reading all the post, it says that she should not overstay by 28 days after her visa expires and I am not sure how long will it take for my passport to arrive when applied for the Settlement.

Please help.

And my question is does she need to? If her current leave will not expire before she makes her two years, she may continue in that category and apply for ILR when the time comes.

Sorry I dont understand what you trying to say.
Her visa expires at the same time as mine. But my passport will be in the homeoffice as I will be applying for settlement.

As she has not lived in UK for 2 years I cannot apply for Settlement at the same time.
So question is when can I apply for her FLR? (My passport will be in the settlement process and one of the requirement for FLR is to send the spouse passport to check the immigration status in this case settled)

Okay, so she will have to apply for FLR(M) and she can bundle her application in with yours, requesting that it be considered in series with yours after it is approved.
