continued residency question

Post by frank346237 » Fri Nov 10, 2006 11:54 am

I am in the process to turn my green card into a citizenship.

For this, besides other things, I need continued residency.
Meaning that I cannot leave the country for more than 6 month.

My question is:

If my plane stopped in New York (e.g. en route from Mexico to Europe) for a couple of hours, I exit through customs and enter again....

Would this reset my continued residency counter?

Thanks for your answer.

continued residence

Probably not. The residence issue has much to do with physical presence in the US and a good faith/bona fide home (permanent) residence in the US so its unlikely that an examiner would accept that a couple of hours maintained one's residence requirements. Nonetheless, this general rules does have some exceptions and needs to be evaluated with much more information than you've provided. I recommend that you consult with an attorney before being certain as to how this rule affects you specifically. Many legal consultations are free.
