PR for A8 countries

Hi guys,

Can anyone help me with following questions?

1. I am wife of EEA national (lithuanian) man. We both were here since Feb 2007. On that time A8 countries were required to register under Working registration scheme and complete 1 year with same employer.
Suddenly he completed 10 month and changed job, did not know that has to re-register... Do you think he still can apply for Permanent residence as he was in employment and self-employment during all 5 years with no gaps or application likely to be rejected?

2.We found out not long ago that he did not need to register udet WRS at all, as he was working on his CIS card (self-employed). So it was mistake from his contractor? Shall we wright explanation letter to HO and still can go ahead with EEA3?

If he was self employed and can prove it, the HO will not ask for proof of WRS.
