WP Expiry

Post by indianraj » Mon Jan 08, 2007 11:23 am

Hi all,

My WP expries today and I have got the FLR until this year end, now the thing is I want to leave the country with out extending the WP next week.

Will I be coming under the Over/Excess stay category and will this be a problem for me If I want to come back in to UK at some other point of time??

Thanks in Advance

Regards
Raj

If you will not renew the WP then you will be considered an overstayer even if you have FLR until end of year. The FLR takes into consideration the WP validity.

"My WP expries today and I have got the FLR until this year end".

Can you just explain what you mean by that, work permits do not normally have an expiry as such, it all goes from the date of the associated visa expiry.

I meant the the expiry date on my VISA is 8th Jan 2007, but I have an extended FLR until this year end, and I do not want to send the my Passport to home office for staming because I need to travel this weekend and I am not coming back.

SO my concern was will i be considered as an over staying illegally????
and will this have any effect on my future WP applications

I think you're confusing your work permit and further leave to remain.

Not sure what you can do, as you didn't apply for the new visa you have technically overstayed.

Thank you for the response, I know that I have overstayed, but my concern is will this effect my future WP/VISA applications for UK??

or Will I have a tough time with the Immigration the next time I come in to UK?

normal case is that the HO will always your new application from scratch meaning it will evaluate your case based on facts provided.

however once they look up your name in their database that previous incident earlier you mentioned will come up and nobody really can tell what will be their final decision.

Perhaps they may contact you further and discuss it you and/or employer so as not repeat the same problem encountered.

Rules says if your WP is extended you have 6 months to apply for FLR but in any case BEFORE your existing LTR expires! I know a friend of mine once filed her FLR application 2 days after her LTR expired but it was granted without a problem.

I don't think 2-3 days overstay ever cause any problem especially if you can justify it.
