Hi All,

I applied for tourist visa for my wife and its refused on Feb 17th 2011, reason stated,

"I have Tier II intra comapny transfer visa which is valid upto 2013 and my wife didnt have any property in here name. so unlikely she will return back to india after the 6 month tourist visa duration"...

Due to worng direction and lack of awarness i had went for tourist visa...so please let me what can i do now...

1) can i apply dependant visa, will the tourist visa rejected have impact on the fresh application for dependant visa ??
or
2) can i apply 6 month tourist visa itself again, since my assignement at UK might be 6 months only, thats one of the reason for applying tourist visa in first place??
or
3) can i appeal against refusal and apply for dependant visa immediately(march 2011) is that allowed ??

Any suggestion/guidance would be really helpful... Thanks in advance...

1. Yes. No.
2. Yes, but it may be refused again unless evidence of strong ties to home country can be proved.
3. If family visitor application as refused, you may have full rights of appeal. You may appeal and apply for entry clearance as dependant in parallel (APL1.20).

Thanks alot for a quick response....

so, you are saying go for Dependant visa and the refusal of tourist will have NO impact on this fresh application.

b.t.w what document to be shown as proof for "strong ties" to home country...

Hi,

As suggested, I had Planned to do dependant visa for my wife, can you please guide on documents to be submitted bearing in mind her tourist visa got rejected a month ago.

1) Any specific letter need to get from my company ??
2) Any specific letter need to be get from my hotel bookings ??
3) Please help on what specific things to be written on covering letter this time around or any format to justify/reason for applying different type visa(dependant) this time around ??
4) is my wife and i need to write a covering letter any format available please ??

# She had no property in her name, only last month created new bank account and put some money in it.
# My father and his dad have property in there name in india.

Hiya,

Our family is currently in the same situation described above.

My question is:

Does my wife need to show any evidence of strong ties to her native country if she is applying for a TIER 2 DEPENDANT?

If NO, will bank statements and the rest of the requested rubbish be enough to support her application?

Any input would be much appreciated. Cheers!
