Can I apply for my son ILR if I have ILR

Can I apply for my son ILR if I have ILR

Hi all.

I am going in person to get ILR and currently I am on Tier 1 and have all relevant paper work to get it..

I will be applying for FLR for my wife as she couldn't pass life in uk test.

My question is our son is 2 years old and is on dependent visa, can I apply for his ILR? or do I need to apply for FLR for him as wel?

If your son was born here, no need to apply for ILR. You can register him as british citizen based on your ILR status using form MN1 and then apply for his passport!

actually his visa is expiring on 8th december. can he overstay on his visa for couple of months
reason i am asking is we have been blessed with another baby after my ILR and I can apply for them both together that might save me some money??

If your child is born in the UK after you are granted ILR, the child is automatically British from birth. There is no need to apply for anything and no money to save ;-) You can apply for a UK passport directly.

The UK born child can overstay if you plan to apply to register him as British once you are granted ILR. However, this would mean he could not travel until the process is completed (several months).
