RETAINED RIGHT OF RESIDENCE

Post by S4h1l » Fri Sep 21, 2012 11:39 pm

Hi
I would like to ask the experts advice on the following matter

Non Eea member married to Eea national in 08/2008
Applied for residence card & recd in 12/2008
Divorced initiated 01/2012 & finalised 06/2012

Now I don't have any proof of Eea member Excersing treaty right to retain right of residence or pr.
Is there any way I can retain right to reside without the proof of Eea member Excersing treaty right ?or is there any way to get hold of these documents?

Looking forward to the experts advice on this issue

Thanks in advance

I take it that your ex-spouse will not co-operate.

Thats right,Ex-partner is not ready to co operate,so is there any way to retain right of residence .
I do have evidence of co habitation for the duration we lived together proof of my earnings council bills on joint names etc.

Is this enough to support my application?

You will need to prove that ex-spouse lived in the UK in accordance with the 2006 regs.
