Tier 4 to Tier 2

Hello all,

I would like some advise on my current situation.

I have a student visa which expires on December 31, 2012. I have recently completed my university degree in the UK last May 2012 and have successfully received my diploma. I was hired by a company last July 2012. Seeing as my visa expires by the end of this year, I will need a sponsor for a Tier 2 visa.

The company I work for doesn't have a sponsorship license and has recently submitted documents to the home office. Assuming it will take 4 weeks for the company to get the license, I will only have 4 weeks to apply for a Tier 2 visa.

Under those circumstances, will I be better off applying for the Tier 2 visa in my home country in order for me not to risk overstaying in the UK?

Employers wishing to be registered sponsors who applied for sponsorship licence in April / May are still waiting for a decision, so the assumption above may be way off track.

For an entry clearance application from outside the UK, your employer will need to assign a restricted CoS.

If you apply outside the UK, the application will be subject to the RLMT.

** Yes, your assumption is way off base. I received a job offer the end of February and my employer submitted their application for registry onto the sponsorship list in March and it still hasn't been processed. I've now decided to do my PhD instead
