BN: when to apply - after 5 yrs or after 12 months of ILR ?

Post by maxima » Tue Jan 30, 2007 9:48 pm

Hi, I am sure I saw before that you can apply on British Citizenship after 12 month after you received ILR. Which may well happened 1 month before 5 yrs in the UK (as you can apply on ILR one month before 4th year).

But now I cant find that document.

My friends applied 12 month after ILR and 1 month earlier than 5 years and received the passports. But it was a year ago.

Can someone please let me know if I can do the same - we received ILR one month before 4th year ended.

I know that it might seen not a big deal - one month. But I want apply asap if there is a legal possibility to do so.

Thank you

There is an unwaivable requirement that you must have been physically in the United Kingdom (or the Channel Islands or Isle of Man) on the exact day 5 years previous to the application being received in the Home Office.

And since that date you must have been living in the UK for 5 years, with ILR for at least 12 months. (maximum days absent are set by law and policy).

You cannot apply early, sorry.
