Unfair Dismissal

Hello,

My wife is on a student visa here and I am on dependent visa. Our visa is expiring today, but I have already posted my visa extension application to the home office.
My wife works in a well known supermarket. Today, she is told that her visa is expiring today and so she cannot work from tomorrow. She showed the postal receipt, and the rule from IND website stating that the visa status is legal and are allowed to work until the application is decided. The employer even called the home office and confirmed it. But still they say the she cannot work from tomorrow. In my opinion this is unfair dismissal.
What should I do to get my rights.
Need of urgent advise.

Did the employer know ur wife's immigration status when she applied for the job? They usually ask nowadays whether u have permission to work/valid visa/time limited visa etc.
