No, she used to be married to a guy who has a portuguese passport but never applied for one herself. I have not been living there, I live in the UK. She has a document from the Potruguese home office that gives her rights to live in portugal, just not a passport. She has her own shop in Madeira.Wanderer wrote:So she lives in Madeira illegally?
Did u live with her there? Do u have proof of this?
Thanks for the rapid replyWanderer wrote:I think ur options are:
1. Go live with her in Madeira. Exercise ur treaty rights and apply for EEA family permit after proving u have a durable relationship - living together for two years is probably the requiremnt.
2. She goes back to Russia and applies for a fiancee visa to join u in UK. Might be difficult since her Russian Travelling Passport will have prolly expired....
3. If she's lived in Portugal for 15 years she must be intitled to some concession for PR - I think u'll need a Portuguese or EU lawyer to untangle that.
4. U've not had a relationship akin to marriage so forget the Unmarried Partners Visa.
Wait for others tho - I know the Russian aspects better than EU!
Udachi, davai poka!
hehe, thanks for the correction... I actually knew that already, was just a rookie mistakeWanderer wrote:You can marry her there or in a third country and then apply for Spouse visa on which she can work immediately.
Her status in portugal might preclude marriage there tho but there are other countries!
And that's 'Spacibo' with an 'o' - albiet unstressed and pronounced as an 'a'!
Ste, Russian Grammar and transliteration Police......
Very interesting... I know she has applied for a passport, so I guess we'll see what comes of that... I think things move a lot slower out there.flyboy wrote:If you girlfriend has held a residence permit in portugal for the last 10 years she's entitled to apply for Portuguese citizenship. Have a look at the following link:

Armed with a portuguese passport she has the right to live and work in the UK / EU without hindrance.
Theres the student visa option too - u sponsor her studies here at a UK uni, live together, then UPV.jimsefton wrote:hehe, thanks for the correction... I would like to avoid immediate marriage if possible... eventually, yes, for sure, but not for a couple of years I'd think
Correct, she has never applied for naturalisation. She submitted all the papers late last year but she tells me the whole process takes 3 years.Marco 72 wrote:Do you mean to say that she never applied for naturalisation as a Portuguese citizen, or that she is a Portuguese citizen but never applied for a Portuguese passport?jimsefton wrote:No, she used to be married to a guy who has a portuguese passport but never applied for one herself.
