Tier 2 switching from PSW -need guidance

Hi All,

Im on the tier 1 post study work visa (received in Jan 2010)and I am looking to switch to tier 2 (General) category. I have been employed in London by Citibank for the last 10 months and am earning around £39,000 pa. the company is a registered sponsor

I would have qualified for the tier 1 general category if I had maintained the £800 maintenance funds. If I start now it would still be too late for me as the route closes in April.

I have some questions regarding switching to tier 2 and would appreciate your comments.

1. Do I need to show maintenance funds?

2. Do I need a COS or is proof of employment like salary slips sufficient?

3. Since Im switching from PSW to tier 2 while in the same job, does the company need to advertise the job?

4. Its a business management role, not on the shortage list, is that a problem?

5. When should I look to apply?

6. My wife is my dependant and is expecting in the next 6 months, will that weaken my application?

No problem, u can switch back to tier 1 later. here are answers to ur questions.

1. NO ;u automatically score points for maintenance without providing proof.

2. U must have COS to apply for tier 2 u also need 6 months payslips to prove that u have been working for same employer for 6 months ( doesn't have to be same job)

3. NO; u are exempted from labour market test*

4. NO

5. ASAP, UKBA is taking ages to issue COS, u said ur employer is licensed, check if they have available COS, in their quota and ask them to apply for ur COS**

6. NO

* U must be getting appropriate pay for ur profession as described by UKBA codes of practice documents.
** ur employer must chose correct Code for ur job in COS application and
there is a question in COS application ''has the applicant passed labour market test?'' click ''yes'' as answer and explain in the box that ''candidate has been working with us for more than 6 months, continuing the same job and scores all points requires for switching from post-study work into tier2.''

General query about Tier 2

Hi All

I am currently holding Psw which is expiring on jan 18 but i have changed my employer recently which has already provided me COS. As i understand i m exempted from resident labour market test because i am holding tier 1 general (psw) My question is,

Do i have to show the proof of maintenance of funds?

I will be highly obliged if you can help me out on that.
