Work status when making second FLR application

Post by goldfish » Sat Feb 10, 2007 6:16 pm

I've applied for an extension but am concerned I may have applied as Salaried when I should have been Self Employed (based on the new FAQ).

If my existing leave expires while they are making a decision on my current application, and it is rejected, can I continue working while I make a new application (instead of an appeal)?

If your leave has already expired (by the time you get the refusal letter), then you are not legal to stay in the country. Ofcourse I guess there is a couple of weeks of buffer time to pack bags and leave the country.

Now you can appeal the decision, and still be legal in the country while the appeal is in progress. However, though I am not 100% sure, you can not make fresh application for FLR, after your leave expires.

Anyway, I would'nt worry too much till I get the decision. It may be an approval as well. But should that be the case, it is best to contact HomeOffice and ask them, if you can apply for FLR while your current leave has expired.

In other words, you will be in the same situation as someone, whose leave has expired and then they are trying to exend their leave with FLR, I am not even sure if they accept a fresh FLR application, if the current leave has already expired.
