ILR Eligibility Tier 2 ICT

Hi
I had a query regarding the ILR eligibility on tier 2 ICT visa

Visa approved - Jan 2009
Travelled to UK - Feb 2009
Travelled back to native country - July 2010

Travelled to UK on same ICT visa - June 2011 and currently on same visa

Will my stay after June 2011 on visa filed and approved before rule change in Apr 2010 be considered for ILR?
