ILR / Naturalisation

Dear Friends

This is regarding the clarifications for ILR in UK

I have my Uk Tier1 visa active from 20 Feb 2009. I entered the country on 09 April 2009 and stayed for 20 days.

Later on, I arrived on 05 September 2009 only to stay for last 3+ years.My current extension expires on 20 Feb 2014.

Should I apply for another extension before ILR or shall i apply for ILR from Feb 20 2009?

Also, is ILR compulsory for the Naturalisation of British Citizen?

You are eligible for ILR from 20 Feb 2009 as long as your absences from the UK are under 180 days/year(in 5 year period).

245AAA. General requirements for indefinite leave to remain:


(a) "continuous period of 5 years lawfully in the UK" means residence in the United Kingdom for an unbroken period with valid leave, and for these purposes a period shall not be considered to have been broken where:

(i) the applicant has been absent from the UK for a period of 180 days or less in any of the five consecutive 12 month periods preceding the date of the application for leave to remain;

Also read 245AAA(b).
ILR is mandatory for BC.
