I think as an EU Citizen YOU have the right to claim Housing benefit etc, but wrt to tuition fees I'm sure not.jango wrote:My husband and I are both fulltime university students, in london. We have a 2 year old son. We got married in London 2004. My husband was a student at that time, later when his student visa got expired, he went back to his come contry, and he got a one year entery clearance visa, and after that we applied to homeoffice, and he got spouse visa, until my education is finished in june 2008. I am a EU citizen, but I have residence permit here.
Now the question is. can my husband get help to pay his tution fee??
Can we get help from Housing Benifit, (full rent) or any finantial help, at all???
is it true that we can not recieve any help until he gets perminent status to leave and remain UK, or will his delay his process to get perminent status.
kind regards hedyeh.
That is not totally correct. Whilst the Child Benefit, a type of benefit claimed by just one person, is correctly in your sole name, as regards Tax Credits in respect of a couple living together a claim must be in joint names. So if the Tax Credits are indeed being claimed just be you, you need to get that changed now!Regarding Child Benifit and Child Tax Credit, the answer is No its is not a joint claime.
Regretfully no.Now the question is. can my husband get help to pay his tution fee??
Housing Benefit is claimed by just one person, although the family income needs to be disclosed. You are entitled to claim. Para 6A of the Immigration Rules prevents you getting more Housing Benefit because your husband is living there, compared to if he wasn't. However, in your circumstances this is not a problem ..... because the income disregard for a "single parent with a child" is the same as for a "couple with a child". Accordingly it cannot be the case that you can get more Housing Benefit because your husband is living there. Indeed you might get less, because your husband's income needs to be taken into account in assessing the amount of your Housing Benefit. Can we get help from Housing Benifit, (full rent) or any finantial help, at all???
Because that is the law .... in respect of a couple ... married or unmarried .... living together .... any Tax Credits claim must be made jointly.why is it so important that I add my husbands regarding the child tax credit?
Please re-read what has already posted. Not sure I can add anything. If we get housing, child benifit, child tax credit, will the home office then not extend his residency status?
