ILR based on 10 Yrs applicable for dependants

Post by chetan » Fri Feb 16, 2007 11:21 am

Hi All,

I am a Tanzanian national.

It will be 10 yrs in july 2007 since i first came to the UK as a student, I switched from student status to workpermit in jan 2003 (just over 4 yrs now) and have been on workpermit since.

During the 10 years period I have once been out of the UK for more than 3 months (approx. 3 months & 2 weeks), will this effect my PR application in july 2007?

I am getting married to a Tanzanian national in may 2007 and will be applying for a dependant visa for my wife in Tanzania, hopefully if all goes well and she gets the dependent visa, Will she get the PR at the same time as me or does she have to wait or switch to another type of visa?

Any help or advice will be much appriciated,
Thank you in advance,
Chetan

Chetan, you need to think carefully how you want to play this. If you make a 10-year application for ILR in say July 2007, then no your wife will not get ILR. Under that route it is not possible to "drag along" dependants to get ILR.

However if you make a 5-year application say next January, then yes, your wife could be entered on the application and would tend to get ILR at the same time as you.

Do appreciate that all applicants for ILR aged 18-65 need to pass the Citizenship Test before applying for their ILR. That applies to both yourself and your wife.
