hi thanks in advance for replying
few questions about eea2 s singh application
i am british citizen execrcised treaty right in italy for 6 months as self employed . my spouse will get soon residence card its in process should arrive in a month .
our next move will be to enter uk and apply for EEA2 singh route.
now as after getting residence card my spouse will have entry to ireland we are planing to take ireland route and enter uk and apply for EEA2 RESIDENCE CARD but doing my non eu spouse would not have valid visa for uk after metock and others my husband valid visa should not be a problem my thinking but if i am wrong or in practice it will make things difficult for us
than we will move to plan B which is FRANCE CLAISE a1 stamp and enter uk and apply for eea2 permit.
as in rush we dont want to do some ting in long run which make things difficult for us.

You say you have exercised your treaty rights by being self employed. What evidence have you accumulated to prove that you have worked?

6 months documents of
company registration , registration with chamber of commerce in italy
charted accountant reports of business.
and the tax we paid in italy.
etc
i think this should be enough .
but main question still remains unanswred about enterning from ireland or shall we enter from claise on A1 stamp .

and apart from that tenency agreement of property we were living on both of us names.
and my spouse residence card as family member of eu citizen that is in process but been told it will be ready for collection in 3 weeks.
we should have that also before we come back
our air line tickts like we travelled together to schengen etc

Do you want to fly to the UK or do you want to drive?
Why not apply for an EEA Family Permit?

At some point the UK will want to verify your claims; whether at a VAC; the border or when you apply for RC.
I'd be inclined to apply for the family permit if I were in your shoes.

the reason not for applying family permit is we are not in rome or milano these are cities where world brige service is and we got children and with chidren its not going to be easy to travel time cost etc.
and there is not any certain time frame of issuing fp and not surety of outcome also
if it gets refused some how its taking more time.
and we want to come back to uk as soon as possible . so thats why either the claise rout france like MELC and some other members used it for surinder singh return we are thinking to take.
with marriage certificate.
residence card issued as family member of eu citizen under article 10.
our joint tenancy agreement .
my british eu citizen right of residence card and registration cartificate.
our childrens residence cards as british eu citizens right of residence cards
chamber of commerce documents . and company registration
charted accountant reports of business
tax we paid on company in italy.
my spouse residence card which confirms we were living in same property.
bank statements of both of us living at same address.
business account statement etc.
we wont be flying we will be either taking ferry from claise france
or from brusless midi eurostar trains.
if we dont choose this route than we are planing to fly too ireland as card issued under article 10 eu family mrember gives right of entry into ireland.
the second route ireland one is a lot easier for us as with child and luggage it will be a lot easier for us .
but if we enter uk from ireland than my spouse will not have a valid uk visa can this cause any problem when we apply for EEA2 residence card for my spouse as sirinder singh or its going to ok as after metock and others visa is not a requirement for family members of eu citizens.
we just want to live in english speaking country as living in italy we had too many problems just because of language barrier.
and it took italy about 5 months to process the card as they wanted to see marriage certificate translated and legalized by italian embassy .
we have to send back all the documents and get translation and legalization done.
now due to poor health o my dad and some other matters which need urgent attention we want to come back to uk or at least if we are in ireland we can visit my parents and if there is any emergency we can go to uk.
and both uk and ireland are english speaking countries .

The EEA FP gives you the preconfirmation that all is OK. But is not strictly necessary.
If you want to go to the UK, then just go for it. No need to mess around in Ireland (unless you want to).
Please let us know how it goes.
